Less than a month after she first filed her Telephone Consumer Protection Act (TCPA) suit against Keller Williams, plaintiff Sydney Thayer has withdrawn her complaint.
Thayer last week filed a document notifying the court of her decision to voluntarily dismiss the suit without prejudice, meaning that she could refile the suit with the same claims and against the same defendants in the future.
No reason for the voluntary dismissal was given in the filing.
Thayer filed her suit in mid-June in U.S. District Court in Rochester, New York. She claimed that Keller Williams violated the TCPA by “initiating, or causing to be initiated, telephone solicitations to telephone subscribers such as Plaintiff and the Do Not Call Registry Class members who registered their respective telephone numbers on the National Do Not Call Registry.” According to Thayer, she had no existing relationship with Keller Williams or any of its agents.
Keller Williams was named in a separate TCPA suit filed in Texas in April 2024. The suit was dismissed by the court earlier this year for the failure to state a claim.
Keller Williams did not return a request for comment. Compass was also named as a defendant in a TCPA suit last month. The suit, which makes similar claims, was filed in U.S. District Court in Portland, Oregon.
