Ten indicted in mortgage fraud scheme

The United States Attorney for the Southern District of Florida charged ten Florida residents with mail fraud, conspiracy to commit mail fraud and wire fraud after investigating a major foreclosure rescue scam.

According to the indictment, between September 2008 and August 2009, the defendants operated boiler rooms that collected advance fees from distressed homeowners in exchange for obtaining loan modifications.

Jason Andrew Vitulano, 38, of West Palm Beach, Fla., is the alleged organizer and operator of FHA All Day.com and two other companies.

In addition, Robert Harry Bacon, 34, of West Newbury, Mass., was an operations manager who wrote and edited sales scripts, while the other eight defendants served as team managers overseeing telemarketers who made thousands of phone calls to homeowners behind on their mortgage payments.

All ten defendants face up to 20 years in prison.

Authorities claim the defendants involved in the scam made "false statements to the homeowners" telling them they had either been approved or pre-approved for loan modifications.
